Terms & Conditions
Effective 4 August 2026
1. Who these terms apply to
These terms and conditions ("Terms") govern any website, hosting, AI receptionist, automation, or related service ("Services") provided by SOVEREIGN WEALTH CONSULTING (PTY) LTD, trading as CreatorFlow ("CreatorFlow", "we", "us"), to a client ("you", "the Client").
CreatorFlow builds custom websites and then hosts and runs them on an ongoing monthly plan — this isn't a build-and-handover service. By accepting a proposal from us, or by paying a setup fee, you agree to be bound by these Terms for that engagement.
2. Proposals and scope
Proposals are based on the scope, plan, and any add-on services described in the relevant proposal. Proposals are valid for 30 days from the date issued unless stated otherwise. Work outside the agreed scope (additional pages, features, or requests beyond what your plan includes) will be quoted separately before we carry it out.
3. Payment
Unless otherwise agreed in writing for a specific engagement, projects are billed as:
- a once-off setup fee, payable before build work begins, to cover the design and build of your site; and
- a monthly plan fee, billed in advance starting at launch, covering hosting, security monitoring, ongoing SEO work, and a limited number of small content updates each month, as set out in your proposal.
Monthly plans run for an initial minimum term set out in your proposal. Invoices are payable within 7 days of being issued. We may pause work, and may suspend hosting for an active site, if an invoice is not paid by its due date.
Requests beyond what your plan includes — extra pages, larger features, custom visual or motion work, copywriting, or add-on services such as the AI receptionist or AI automation (including usage beyond any included call-minute allowance) — are quoted and billed separately.
Pricing for our plans and add-ons is provided directly in a proposal tailored to your project and isn't published on this website, as it depends on the scope of what you need.
4. Timelines and monthly changes
Build timelines are estimates. They depend on you providing timely feedback, content, and any access or accounts we need to do the work. Delays caused by late feedback or missing materials will extend the timeline accordingly and are not a breach of these Terms by CreatorFlow.
Once your site is live, your monthly plan includes a limited number of small content or design update requests, as set out in your proposal. Larger change requests, or requests beyond your monthly allowance, are quoted and billed separately or carried over to the next month, at our discretion.
5. Ownership, hosting, and intellectual property
Because CreatorFlow builds, hosts, and continues to run your site as part of an ongoing plan, CreatorFlow retains ownership of the site's code, design, and hosting environment for as long as it is active on a CreatorFlow plan. You have the right to use and operate your site as your business's website for as long as your plan is active and in good standing.
Reusable tools, frameworks, components, and know-how that CreatorFlow develops or uses across multiple client projects remain CreatorFlow's property.
Unless you tell us otherwise in writing, CreatorFlow may display your site in its portfolio and case studies.
See Section 6 for what happens to your site if you cancel your plan.
6. Cancellation
You may cancel before build work begins for a full refund of your setup fee. Once build work has started, the setup fee is non-refundable, as it covers work already carried out and time reserved for your project.
Monthly plans run for the minimum term set out in your proposal. After that minimum term, either party may cancel the plan with 30 days' written notice. If you cancel before the minimum term ends, you remain liable for the fees due for the remainder of that term, unless we agree otherwise in writing.
On cancellation, we'll work with you in good faith to migrate your site to a new host, for a reasonable fee to cover that work unless we agree otherwise. If a plan ends without payment or without migration being arranged, we may take the site offline.
Either party may terminate an engagement for material breach of these Terms that is not fixed within 14 days of written notice. You remain responsible for paying for any fees due up to the date of termination.
7. Confidentiality
Both parties agree to keep confidential any non-public business, technical, or client information shared during the course of a project, and to use it only for the purposes of that project.
8. Warranties and liability
We carry out our Services with reasonable skill and care. We do not guarantee specific business outcomes — such as a particular volume of leads, bookings, sales, or search-engine rankings — as these depend on factors outside our control.
Our Services rely on third-party infrastructure and platforms (hosting and server providers, APIs, booking and payment tools) that we do not control. We monitor uptime and take reasonable steps to keep your site available, but we do not guarantee uninterrupted hosting and are not liable for outages, price changes, or policy changes made by those providers.
To the extent permitted by law, CreatorFlow's total liability for any claim arising from an engagement is limited to the fees you paid us in the 3 months before the claim arose, and we are not liable for indirect or consequential loss.
9. What's included in your monthly plan
Unless your proposal states otherwise, an active monthly plan includes:
- Hosting, uptime monitoring, backups, and security patching for your site;
- Ongoing SEO tracking and on-page optimisation;
- A limited number of small content or design update requests each month; and
- A short monthly summary of what changed and what's working.
The exact scope of what's included depends on the plan set out in your proposal.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will first be addressed through good-faith discussion between the parties; failing resolution, it will be subject to the jurisdiction of the South African courts.
11. Changes to these Terms
We may update these Terms from time to time. The version in effect on the date you accept a proposal or pay a setup fee applies to that engagement.
